STANDING UP FOR HOMEOWNERS

We are willing to stand up for the homeowner and fight the Home Owner’s Association (HOA).  At John B. Miller & Associates, P.C., our HOA practice revolves primarily around homeowner representation.  While most HOA firms focus on association representation, we realized that there was a lack of attorneys in Georgia willing to stand up against the often well-funded HOA.

There are multiple issues that can arise out of an HOA dispute.  HOA boards can mismanage or improperly run the homeowner’s association.  Homeowners can be unfairly targeted.  Provisions of the HOA can be unequally enforced or selectively enforced.  Proper procedures can be neglected, and the very rules of the HOA can be used in an abusive way.  While most of our client’s want their HOA to be strong and able to enforce the rules, they do not want to see the rules used to prevent problem neighbors abused in order to exert  power over those who are in compliance.  Even when a homeowner is out of compliance with the rules, the response should be well-reasoned and appropriate.
